Terms of Service
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Botable ("Company," "we," "us," or "our") governing your access to and use of the Botable platform, including our website, applications, APIs, and all related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Description of Service
Botable is an AI-powered platform that enables users to create, customize, deploy, and manage Telegram bots through a conversational interface. The Service includes:
- AI-assisted bot creation and modification using natural language instructions.
- Managed hosting infrastructure for continuous bot operation (24/7 uptime target).
- A web-based dashboard for bot management, monitoring, and configuration.
- Isolated SQLite database provisioning for each bot.
- Code viewing and file management tools.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
4. User Accounts
To access the Service, you must create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your account information.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
You may not transfer your account to another person or use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
5. Credits, Payments, and Billing
The Service operates on a credit-based model:
- Free credits: New accounts receive 3 complimentary credits upon registration.
- Credit consumption: Each bot creation or modification operation consumes 1 credit.
- Purchased credits: Additional credits may be purchased through the Platform. Purchased credits do not expire.
- Non-refundable: All credit purchases are final and non-refundable, except where required by applicable law.
- Payment processing: Payments are processed through Telegram Stars and are subject to Telegram's applicable payment terms and conditions.
- Price changes: We reserve the right to modify credit pricing at any time. Price changes will not affect credits already purchased.
You are responsible for all applicable taxes associated with your use of the Service.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service to:
- Create bots that violate Telegram's Terms of Service, Bot API Terms, or any applicable laws or regulations.
- Distribute spam, unsolicited messages, phishing content, malware, or other harmful or deceptive material.
- Engage in activities that could damage, disable, overburden, or impair the Service or its infrastructure.
- Attempt to gain unauthorized access to other users' accounts, bots, data, or any part of the Service.
- Use bots for harassment, stalking, threats, hate speech, discrimination, or any form of abuse.
- Facilitate fraud, money laundering, terrorist financing, or any other illegal financial activity.
- Collect, harvest, or store personal data of third parties without their explicit consent.
- Infringe upon the intellectual property rights of any third party.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Resell, sublicense, or redistribute the Service or access thereto without our prior written consent.
- Use the Service to build a competing product or service.
We reserve the right to investigate and take appropriate action against any violation of this section, including without limitation, suspending or terminating your account, removing offending bots, and reporting violations to law enforcement authorities.
7. Intellectual Property
Our IP: The Service, including its design, features, code, content, trademarks, and all related intellectual property, is owned by Botable and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
Your content: You retain ownership of the bot configurations, custom code, and content you create using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to host, store, and process your User Content solely for the purpose of providing and improving the Service.
AI-generated code: Code generated by our AI system on your behalf is provided to you under a non-exclusive, worldwide, royalty-free license. You are free to use, modify, and distribute such code. However, similar or identical code may be generated for other users, and we make no guarantee of uniqueness or exclusivity.
8. Bot Responsibility and Disclaimer of Liability for User-Created Bots
You acknowledge and agree that Botable is a self-service platform that provides tools and infrastructure to enable users to create, deploy, and operate their own Telegram bots. Botable does not create, own, control, supervise, endorse, review, edit, moderate, screen, or curate the content, behavior, code, configuration, conversations, or operation of any bot built using the Platform. Every bot is the sole creation, property, and responsibility of the User who built, owns, and operates it.
8.1 Sole Responsibility of the User. You are, and shall at all times remain, the sole and exclusive party responsible and liable for every aspect of every bot you create, configure, instruct, deploy, host, distribute, share, sell, license, market, or operate through the Service, including, without limitation:
- The content, instructions, code, prompts, descriptions, names, branding, marketing claims, and any output produced or disseminated by the bot.
- The behavior, decisions, recommendations, responses, advice, transactions, payments, or actions performed by the bot or facilitated through it.
- All interactions between the bot and any end user, customer, recipient, viewer, member, subscriber, or third party (collectively, "End Users"), including any harm, loss, offense, damage, distress, or injury that any such End User may suffer.
- Compliance with all applicable laws, regulations, statutes, treaties, judicial orders, and governmental requirements in every jurisdiction in which the bot is made available or used, including but not limited to laws concerning consumer protection, advertising, financial services, healthcare, gambling, lotteries, alcohol and tobacco, firearms, controlled substances, taxation, export controls, sanctions, anti-money-laundering (AML), counter-terrorist financing (CTF), know-your-customer (KYC), age restrictions, child safety, online safety, content moderation, hate-speech laws, defamation laws, electoral laws, and intellectual property laws.
- Compliance with Telegram's Terms of Service, Bot Terms of Service, Bot API Terms, Privacy Policy, and all guidelines, rules, and policies published by Telegram from time to time.
- All data — including personal data, sensitive data, special-category data, financial data, health data, biometric data, and children's data — that the bot collects, receives, processes, transmits, stores, retains, deletes, or shares, and full compliance with all applicable data-protection and privacy laws, including, without limitation, the EU GDPR, UK GDPR, California Consumer Privacy Act (CCPA / CPRA), Brazilian LGPD, Israeli Privacy Protection Law, PIPEDA, and any other equivalent or successor legislation.
- Obtaining and maintaining all required licenses, permits, registrations, authorizations, consents, opt-ins, age verifications, and acknowledgements from End Users prior to engaging them through the bot.
- Drafting, publishing, and enforcing the bot's own terms of service, privacy policy, refund policy, cookie policy, content policy, and any other legal notices applicable to the bot.
- Operating as the "controller," "data controller," "business," or equivalent legal role under all applicable data-protection laws with respect to End User data processed through the bot.
- Responding to any request, inquiry, complaint, takedown notice, subpoena, regulatory order, data-subject access request, deletion request, or rectification request submitted by any End User, governmental authority, regulator, court, or third party concerning the bot.
- All payments, refunds, chargebacks, disputes, taxes, duties, levies, surcharges, and accounting obligations arising from any commercial or financial activity conducted through the bot.
- The accuracy, reliability, timeliness, legality, and appropriateness of any information, advice, recommendation, valuation, opinion, diagnosis, prediction, instruction, or content provided by the bot, including any output generated by AI, large-language models, or third-party APIs invoked by the bot.
- Securing, encrypting, backing up, and protecting any data the bot stores, including all credentials, secrets, API keys, and authentication tokens placed inside the bot.
8.2 Botable Does Not Endorse or Monitor Bots. Botable does not review, approve, certify, audit, supervise, or otherwise vet any bot before, during, or after its creation. The existence of a bot on the Service does not represent any endorsement, recommendation, warranty, or guarantee by Botable, and Botable is not the publisher, author, originator, or speaker of any content produced or disseminated by any bot. Any inference that Botable has reviewed, approved, or stands behind a particular bot is expressly disclaimed.
8.3 Examples of User-Only Liability (Non-Exhaustive). Without limiting the generality of Section 8.1, you (and not Botable) are exclusively and unconditionally responsible and liable for any and all consequences arising from the use, misuse, abuse, or operation of any bot you create, including, by way of illustration only:
- A bot that distributes spam, unsolicited commercial messages, bulk messaging, phishing links, malware, ransomware, spyware, viruses, or harmful code.
- A bot that engages in, facilitates, or markets fraud, scams, deceptive practices, pyramid or Ponzi schemes, false advertising, or impersonation of any person, brand, or organization.
- A bot that conducts unlicensed financial activity, unauthorized investment advice, unlicensed money transmission, cryptocurrency-related illegality, market manipulation, insider trading, securities-law violations, or tax evasion.
- A bot that engages in or facilitates harassment, threats, stalking, doxxing, bullying, intimidation, hate speech, incitement to violence, terrorism, extremism, or any unlawful discrimination.
- A bot that distributes, generates, or solicits child sexual abuse material (CSAM), non-consensual intimate imagery, sexual content involving minors, or any content that exploits or endangers children.
- A bot that infringes upon any copyright, trademark, patent, trade secret, right of publicity, right of privacy, or any other intellectual-property or proprietary right of any third party.
- A bot that defames, libels, slanders, or publishes false or damaging statements about any individual, business, brand, or organization.
- A bot that collects, sells, rents, leases, or otherwise transfers End User data without lawful basis, valid consent, or required disclosures, or in violation of any privacy law.
- A bot that operates in or targets jurisdictions where its activity is illegal, restricted, or requires a license the User does not hold.
- A bot that gives medical, legal, financial, psychological, or other professional advice in a manner that causes injury, loss, or damage to End Users.
- A bot that suffers from bugs, errors, vulnerabilities, downtime, data loss, security breaches, or other technical issues — whether or not the underlying code was generated, suggested, or modified by an AI feature provided through the Service.
- A bot used to organize, promote, or carry out criminal activity, money laundering, terrorist financing, weapons trafficking, human trafficking, illegal drug sales, or sanctions evasion.
- A bot that violates Telegram's policies, resulting in any sanction, suspension, ban, fine, takedown, or other action by Telegram against the User, the bot, or any related account.
- Any other act, omission, content, or behavior of the bot that causes, contributes to, or is alleged to have caused, any loss, harm, claim, regulatory action, fine, penalty, lawsuit, settlement, injunction, or reputational damage.
8.4 Disclaimer of Botable Liability. To the maximum extent permitted by applicable law, Botable, its parent, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, consultants, agents, suppliers, licensors, and successors (collectively, the "Botable Parties") shall have no liability whatsoever — whether in contract, tort (including negligence), strict liability, statute, indemnity, restitution, equity, or any other legal theory — for any direct, indirect, incidental, consequential, special, exemplary, punitive, or any other type of damages, losses, costs, expenses, fines, penalties, claims, demands, or causes of action arising out of, relating to, or in any way connected with: (a) any bot created, deployed, hosted, operated, or distributed by any User through the Service; (b) any content, code, output, decision, recommendation, or behavior of any such bot; (c) any interaction, communication, transaction, or relationship between any such bot and any End User or third party; (d) any breach by any User of any law, regulation, third-party right, or third-party agreement (including Telegram's terms); (e) any data collected, processed, stored, transmitted, lost, leaked, or breached by any such bot; or (f) any failure, defect, vulnerability, or interruption of any such bot, even if Botable was advised of the possibility of such damages.
8.5 No Agency or Partnership. Nothing in these Terms, the Service, or your use of the Platform creates any agency, partnership, joint venture, employment, fiduciary, franchise, or similar relationship between you and Botable. Bots created by Users are operated by the Users in their independent capacity, and not by, for, or on behalf of Botable in any way.
8.6 End User Relationships. Any contractual, commercial, or other relationship between you (or your bot) and any End User is solely between you and that End User. Botable is not a party to such relationships and shall have no responsibility, obligation, or liability of any kind to any End User of any User-created bot. End Users do not become customers or users of Botable by virtue of interacting with a User-created bot.
8.7 Indemnification for Bot Activity. In addition to and without limiting the indemnification obligations set forth in Section 14 of these Terms, you agree to defend, indemnify, and hold harmless the Botable Parties from and against any and all claims, demands, actions, suits, proceedings, investigations, liabilities, damages, judgments, settlements, fines, penalties, costs, and expenses (including reasonable attorneys' fees, expert fees, and court costs) of any kind, whether known or unknown, asserted by any End User, any third party, any governmental authority, or any regulator, arising out of, relating to, or in any way connected with any bot created, owned, configured, deployed, operated, or distributed by you, or any activity, content, behavior, or output of such bot, or any breach or alleged breach by you of these Terms.
8.8 Suspension and Removal at Botable's Discretion. While Botable has no obligation to monitor or review bots, Botable reserves the right (but not the duty) to, at any time and in its sole discretion, with or without notice: investigate, suspend, throttle, restrict, disable, remove, delete, or terminate any bot, account, or User Content that Botable believes — in its sole and exclusive judgment — may violate these Terms, applicable law, Telegram's policies, or that may otherwise expose Botable, its users, or any third party to harm, liability, or reputational risk. Botable shall have no liability to you or to any third party for taking, or for declining to take, any such action.
8.9 AI-Generated Code Disclaimer. The Platform offers AI-assisted features that may generate, modify, or suggest code, configurations, prompts, or content on your behalf. Such AI output is provided "as-is" for your convenience only. You remain solely responsible for reviewing, testing, validating, securing, and assuming all consequences of any AI-generated material before, during, and after deploying it as part of your bot. Botable makes no representation that AI output will be accurate, complete, fit for a particular purpose, secure, free of errors or vulnerabilities, or non-infringing, and disclaims all liability for any reliance on or use of such output by you or any End User of your bot.
8.10 Acknowledgement. You expressly acknowledge that the limitations and disclaimers set forth in this Section 8 are a fundamental basis on which Botable provides the Service to you, that Botable would not be able to offer the Service on the current commercial terms without these limitations, and that the allocation of risk between you and Botable as set forth herein is fair, reasonable, and bargained-for.
9. Data and Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
Each bot operates in an isolated environment with its own dedicated SQLite database. We do not access, monitor, or share the data stored in your bot's database except as necessary to provide the Service, comply with legal obligations, or enforce these Terms.
10. Third-Party Services
The Service integrates with and relies upon third-party services, including but not limited to Telegram, Clerk (authentication), and various APIs that your bots may interact with. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services.
11. Service Availability and SLA
We use commercially reasonable efforts to maintain the availability of the Service and your bots. However, the Service is provided on an "as available" basis. We do not guarantee uninterrupted, error-free, or secure operation of the Service. Planned and unplanned downtime may occur due to maintenance, updates, infrastructure issues, or circumstances beyond our control (including force majeure events).
We shall not be liable for any loss or damage arising from service interruptions, data loss, or delays in the operation of the Service.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from the Service will be accurate or reliable; (d) any AI-generated code will be free of bugs, vulnerabilities, or errors; or (e) the Service will be compatible with any particular third-party software or hardware.
13. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Botable, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:
- Your access to, use of, or inability to access or use the Service.
- Any conduct or content of any third party on the Service.
- Any content obtained from the Service, including AI-generated code.
- Unauthorized access to, use of, or alteration of your transmissions or content.
- Errors, bugs, or inaccuracies in AI-generated bot code or configurations.
- Any actions taken by your bots or their interactions with end users.
In no event shall our total aggregate liability exceed the greater of fifty US dollars ($50) or the amount you have paid us in the twelve (12) months preceding the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless Botable and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content or bots; (c) your violation of these Terms; or (d) your violation of any rights of another party, including end users of your bots.
15. Termination
By us: We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or illegal activity, extended inactivity, or upon request by law enforcement.
By you: You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.
Effect of termination: Upon termination, all running bots under your account will be stopped. Your bot data and files will be retained for a period of 30 days, after which they will be permanently deleted. Unused credits are non-refundable upon termination. Sections of these Terms that by their nature should survive termination shall survive (including, without limitation, intellectual property, disclaimers, indemnification, and limitation of liability).
16. Dispute Resolution
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration or the competent courts of the jurisdiction in which the Company is established.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.
17. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email at least 14 days before they take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and terminate your account.
18. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Botable regarding the Service and supersede all prior agreements and understandings.
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
- Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, labor disputes, government actions, or internet or infrastructure failures.
